Please thoroughly review these terms and conditions of Venator Management LLC, DBA Footprints Travel, herein referred to as Footprints Travel.    These terms and conditions complement the terms and conditions contained in the relevant documents provided from third-party service providers (“Suppliers”) and describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms "we", "us" and "our" refer to Footprints Travel. The term "you" refers to the customer visiting our website, booking a reservation through us or otherwise using our services. You are deemed to have read, understood and accepted these terms and conditions for travel related services.

 

 

By booking your reservation with us or using our website, you are agreeing to be bound by the terms and conditions herein,  and any  additional terms and conditions of  any  Supplier that are  applicable to  your booking or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

 

 

You represent and warrant that (a) you are of sufficient age of 18 to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all  terms  and  conditions applicable to  their  travel reservation. You  understand that you  are  financially responsible for any use of our services or website by you and those using your name or account.

 

 

1. Products and Suppliers

 

 

We sell a variety of travel related products from different Suppliers. Each Supplier has its own terms and conditions that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us, or our Suppliers, your use of which may be subject to further conditions. Our website, which is referred to throughout these terms and conditions, can be found at www.footprintstravel.biz.

 

 

Footprints Travel is acting as intermediary for products and services that are not directly supplied by us (e.g., air  carriage  and  ground  transportation, hotel  accommodations, meals,  tours,  cruises,  etc.).  You  will  be entering into a separate contract with such Suppliers in connection with such products and services.

 

 

Footprints Travel shall not be responsible for any loss, damage, delay, inconvenience or injury to you or group members as a result of a breach of contract, act or omission whether willful or negligent, criminal or otherwise of any person other than Footprints Travel or its direct employees, including but not limited to these Suppliers, their employees, agents, servants, or representatives.

 

 

Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Footprints Travel is not responsible for Supplier deviations, delays,  cancellations, mandated  overnight  stays,  missed  connections  or  any  other  condition  beyond  its control.

 

While  Footprints  Travel  prides  itself  on  selecting  top  quality  Suppliers,  no  undertaking,  guarantee  or warranty is  given  or  shall  be  implied as  to  the  fitness  or  condition of  the  Supplier’s accommoda tions, transportation,  or  any  food,  drink,  medicine,  or  provisions  supplied.   Footprints  Travel  shall  not  be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier.  In no event shall Footprints Travel be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, on shore excursions, or  during any mode of  transportation encountered during the trip, resulting from equipment or any other cause. You admit a full understanding of the nature and character of the mode of transport and assume all risks of travel, transportation and handling of passengers and baggage.

 

 

2. Pricing

 

 

Prices and availability quoted by Footprints Travel are not guaranteed until deposit is fully paid. Pricing and availability may change without notice. You agree that we are not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor are we responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold us harmless for any actions or damages arising from Supplier pricing.

 

 

3. Reservation, Deposit and Payment

 

 

Payment of a deposit enables us to hold a reservation for you, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with any corresponding Suppliers.

 

 

After payment, the conditions of the contract with your Supplier may permit them to increase the cost of your reservation. We will pass on any such increase to you as we become aware of such increase. Changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the p rice of your reservation may change after you have paid in full.

 

 

All group reservations are subject to a minimum group size in order for the confirmation to be effective and for the reservation to be finalized.

 

 

4. Cancellation and Changes by You

 

 

You are allowed to cancel your reservation in writing, at any time prior to the departure date. You may be entitled to a partial refund. However, cancellation terms and conditions will apply.

 

 

For tours operated by Footprints Travel, cancellation terms and conditions are specific for each tour and available within the corresponding tour brochure. The cancellation refund policy is computed based on the length of notice period prior to the departure and the total cost of the tour fare, as the case may be.

 

 

For tour products or individual components provided by Suppliers, cancellation fees under the terms and conditions of the respective Supplier shall apply plus an additional administrative fee from $50 per service per person.  Refunds will only be paid to you once we have received the funds back from the Supplier(s). We are not responsible for a Supplier’s failure to pay a refund.

 

Where a change requested by you to your travel reservation is permitted and possible, an administrative fee from  $50  per  service  per  person  will  apply  in  addition  to  any  Supplier  charges.  Please  note  that  all reservation changes are subject to availability and the terms and conditions of the product purchased.

 

 

Changes to name details are not allowed by many Suppliers. While we will endeavor to make such a change if necessary, please bear in mind that most Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

 

 

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

 

 

If you have a problem during your travel, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us, either by phone or email, or through www.footprintstravel.biz. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under these terms and conditions.

 

 

5. Cancellation and Changes by Us

 

 

Please note that Footprints Travel is acting as an agent for services rendered. Your contract with us, and our Suppliers, may allow cancellations or changes in tour itineraries. Even after deposit or full payment has been made, all reservations are still subject to cancellation and/or changes.

 

 

If due to some unforeseeable circumstances or group minimum requirement not met, and the reservation has to be cancelled, we will attempt to notify you at least 1 week before departure. We may recommend alternative tours either to the same destination or other tours, based on current tour fare. Should you decide not to accept the alternatives, a refund will be made accordingly without further obligations. We shall also not be held liable for any contingent costs incurred by you arising from the cancellation. You shall receive the refund within 2 to 4 weeks upon us notifying you of the tour cancellation. Save as stated herein, we shall not be liable for any claims, losses, damages or costs sustained by you.

 

 

We will make reasonable effort to avoid changes in the itinerary. However, we reserve the right to make minor changes at any time due to unforeseen circumstances, especially during peak periods or in the event of a force majeure.

 

 

Prior to departure we will ensure that you are promptly notified of any significant changes once we become aware of such change, but we accept no liability for any changes or costs incurred that may result. Subject to the  Supplier’s  terms  and  conditions,  you  may  have  the  choice  of  accepting  the  change  of  reservation, accepting an offer of alternative travel reservation if one is made available by the Supplier, or canceling your booked reservation and receiving any applicable refunds. We do not guarantee that any refunds will apply.

 

 

No refund will be made with respect to accommodation, meals, sightseeing tours or any other services included in the tour fare but not utilized, either in part or full, or where the services are amended, cancelled or otherwise varied arrangements after commencement of the tour.

 

6. Travel Documentation and Destinations

 

 

Our general practice is to send documents to you electronically whenever possible. We reserve the right to charge an administration fee should you make a request for such documents to be sent as a hard copy.

 

 

It is your responsibility to immediately review all aspects of your booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, supplier, arrival/departure travel dates & times, accommodations, and organized activities on your booking receipt. Please notify Footprints Travel immediately if any omissions and/or corrections are needed regarding the booking details. You voluntarily assume full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. You are required to verify the accuracy of your LEGAL first & last names. It is mandatory that guest names be identical to the names as they appear on booking and travel documents.

 

 

Prior to booking travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.

During any current or on-going global situation, the customer takes full responsibility for any monetary investment in the event the trip is cancelled and the supplier is not able to provide a refund.

 

 

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

 

 

It is your responsibility to fulfill the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

 

 

7. Travel Insurance Protection

 

 

Travel insurance is Strongly Recommended. As your travel manager, we have a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation. While we do offer coverage through certain carriers, we cannot compare all the policies or companies currently in the marketplace. This responsibility rests solely with you the customer and we advise you to do your research and find coverage that best fits your individual needs. Footprints Travel is limited to advising you of the need for such coverage.

 

 

Failure to sign and return your insurance acceptance form will constitute your declining the insurance. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel protection section of your confirmation. By declining travel protection, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of- pocket expenses incurred.  You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. If you HAVE purchased travel protection, please remember to review your confirmation for accuracy and call us immediately if you believe you have travel protection and your confirmation indicates declined. Failure to contact us will be considered waiver of travel protection.

 

 

We  urge  you  to  read  your  policy  when  it  arrives  as  it  contains  important  information.  This information includes, but is not limited to, details on the  extent of coverage and procedures for making a claim.

 

All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. Footprints Travel is not able to give advice with regard to possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, coverage  should  be  directed  to  your  particular  travel  insurance  provider.   Please  note  that  the  travel insurance provider may not be allowed to discuss your claim with us  due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that Footprints Travel cannot be involved in any aspect of your claim/request for service and agree that we have no control over the travel insurance provider or its coverage decisions, and as a result Footprints Travel is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.

 

 

8. Disabilities

 

 

Footprints Travel recommends that all travelers be in good physical and mental health and have medical approval to travel. Any physical disabilities must be reported to Footprints Travel at the time of reservation upon initial booking so we can contact the Suppliers to investigate amenities and/or special accommodations offered.  Each traveler is required to provide his or her own personal or individually prescribed devices such as wheelchairs, walkers, or similar devices. If more than minor assistance is needed, Supplier s require that the  traveler  be  accompanied  by  a  companion  who  is  capable  of,  and  responsible  for,  providing  such assistance. Suppliers often reserve the right to reject travelers whose mental or physical condition may interfere with the itinerary. Footprints Travel  shall be held harmless for any and all  claims relating to Supplier rejection relating to mental or physical condition.

 

 

9. Group Tour/ Cruise Inclusions

 

 

Accommodation:  Accommodation is as specified in the tour brochure and based on double occupancy. Single room occupancy is at additional cost.  Baggage:  Allowed one check-in luggage and one piece of carry- on luggage per person not exceeding current size & weight restrictions.                     Meals: Meals are as indicated in the tour brochure. If meals are not served due to conditions beyond our control, there shall be no refund or

replacement.  

Seat Assignments: Motorcoach seating is assigned when deposit is received and may be rotated  during  the  period  of  the  tour.                                      Single  Supplement: For  occupancy  of  a  single  room,  single supplement amount as indicated in the tour brochure is required.                                         Special Requests: Special requests regarding special meals, dietary requirements, adjoining rooms etc. should be made at time of booking. Such

requests are subject to availability and confirmation.

 

 

Pricing Policies Validity: All information and prices shown are accurate at time of print.  Group Tour/ Cruise fare includes: accommodation, airfare (if any), airport transfers (if any) and meals (if any), port fees, government  taxes,  customary  gratuities  (onboard,  driver,  baggage  handling)  as  specified  in  the  tour brochure. Tour fare excludes travel insurance, laundry, excess baggage charges, beverages, room services, optional tours, personal expenses, etc.; and increases due to abnormal cost fluctuations and/or circumstances beyond Supplier control.

 

 

10. Rights and Disclaimers Relating to Group Tours/ Cruises or Events

 

 

Where Footprints Travel has not been negligent nor in breach of any duty, it assumes no responsibility for injury, damage, accident, loss, delay or irregularities that may be caused to person or property where such occur as a result of circumstances beyond its control. As an agent of airlines, transport companies etc., we are not liable for changes made by suppliers but will render assistance wherever possible. All tickets, coupons and orders are furnished and issued, subject in every respect to those terms and conditions under which the means of transportation or other services provided thereby are offered or supplied by owners, operators, managing agents or agents of public carriers.
